Mediation

Many people successfully resolve issues in their case through mediation and/or arbitration. Mediation is the process of negotiating disputes with the assistance of a neutral third party. Mediation is non-binding, meaning that if the parties are unable to compromise, the mediation ends and the dispute can then be litigated.

In some cases, the parties elect to use arbitration, which is a type of dispute resolution in which a third party, mutually agreed to by the parties, conducts an evidentiary hearing and enters a binding order that is then approved by the court as a Court order.

There are additional expenses related to mediation and arbitration, but mediation and arbitration can normally be arranged to occur much earlier than can a hearing in court. It is often said that a negotiated agreement is preferable to litigation and the entry of orders by a judge who is a relative stranger to the case. Parties will realize a significant cost savings if they successfully mediate issues instead of going to court.

We believe that most cases can be resolved through negotiation and compromise. We have found the assistance of a mediator can be invaluable in helping parties to be heard and in helping parties to find the middle ground in their disputes. There are excellent family law mediators available to assist in resolving any or all of your disputed issues. If you do go to mediation, it is important to first consult with an attorney so that you fully understand your rights and responsibilities. It is preferable to have your attorney present at mediation so that you understand all the implications of the agreements that are being discussed. If this is not possible, you should only sign a mediation agreement after you fully understand the legal implications associated with your agreement.
