Do you need a lawyer?

You do not need an attorney to obtain a divorce decree in Colorado. The Colorado State Judicial Branch provides a self-help website on which there are links to many of the forms that are utilized in cases involving divorce, custody (the allocation of parental responsibilities), paternity, adoption and modifications of exiting orders in cases. These forms can be found at: http://www.courts.state.co.us/chs/court/forms/selfhelpcenter.htm

Divorce can be a complicated process when there are issues involving children. Agreements and court orders can have long-lasting ramifications and may be difficult or impossible to change. A lawyer can help you understand your rights and issues related to parental responsibility. And, if necessary, the legal requirements necessary to change court orders concerning your child(ren).

Upon the entry of a Decree of Dissolution of Marriage, the court will issue orders concerning the living arrangements for your children, including how holidays will be divided. There will be orders allocating the rights to make decisions concerning your children’s health, education, and religious upbringing. Once such orders are entered, it can be time consuming, expensive, and emotionally exhausting trying to have court orders modified. It is important to do it right the first time. It is important for you to understand the future implications of agreements you make and of orders that the court issues. A lawyer can negotiate on your behalf so that your needs are met or modifications are filed.

Divorce can also be complicated when there are assets to divide such as a business or retirement account, or when one party is seeking maintenance (spousal support or alimony). It is important to understand the options reguarding maintenance and have assets valued in order to achieve a fair division of marital property. A lawyer can help you determine separate property vs. marital property and advise you regarding a fair division of assets and debts.
