Relocation

A party who seeks to move to another state or area that will affect the existing parenting time schedule must notify the other parent in writing. Notification must include specific information, including the reason for the proposed move, the location of the proposed move and a proposed revised parenting time schedule.

If agreement cannot be reached on the relocation, the person who wishes to relocate must file a request with the court and obtain court approval for the move. Once the request is filed, the court will set a hearing to allow both parties to present their reasons for and against the move.

In determining whether to grant a request to relocate, the Court must consider many factors including:

  • The reasons for the move
  • The reasons for the objection to the move
  • The history and quality of each parent’s relationship with the children
  • Educational opportunities available at the existing and proposed locations
  • The presence or absence of extended family at the existing and proposed locations
  • The impact of the proposed move on the children

Relocation cases present difficult decisions for courts, and the law in this area is still evolving.
